Subject: 9503/Amend 9428/buffer zone Date: Mon, 4 Jun 1990 17:11:00 -0500 ORDINANCE NO. 9503 AN ORDINANCE TO AMEND THE ORDINANCE NO. 9428, ENCAPTIONED AS SET FORTH HEREIN, SO AS TO REQUIRE A BUFFER ZONE IN ACCORDANCE WITH ARTICLE VII, SECTION 1014.5 A AND/OR B OF THE ZONING ORDINANCE. ______________________________ WHEREAS, on August 21, 1990, the City Council of the City of Chattanooga, Tennessee, enacted Ordinance No. 9428 encaptioned, "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 7454 EAST BRAINERD ROAD, BEING ON THE SOUTHWEST LINE OF EAST BRAINERD ROAD NORTHWEST LINE OF EAST BRAINERD ROAD NORTHWEST OF SOUTH JOINER ROAD FROM R-1 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL DISTRICT AND R-4 SPECIAL ZONE."; and WHEREAS, the minutes of the City of Chattanooga Council of August 21, 1990, indicate the condition to require a buffer zone in accordance with Article VII, Section 1014.5 A and/or B of the Zoning Ordinance was discussed and approved; and WHEREAS, said condition was not inserted into the final ordinance when passed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9428, encaptioned as set forth above, be and the same is hereby amended by adding the 0C following condition: "That there be required a buffer zone in accordance with Article VII, Section 1014.5 A and/or B of the Zoning Ordinance." BE IT FURTHER ORDAINED, that this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it, provided, however, that this Ordinance shall be operative immediately upon passage on third and final reading.
